ARCHITECTURAL SERVICES

  1. The standard scale of fees is for comprehensive services including pre-design study, architectural, structural/electrical and plumbing designs and interiors.  To ensure quality work, architects will be engaged only on comprehensive services and partial services should be avoided.
     
  2. The fee structure is based on tendered cost of total project including site development, civil and electrical works, lifts, landscaping and interiors. Where whole or part of the project is not executed, the fee will be on the cost calculated on prevailing rates, that is, market rates or scheduled rates plus current tender percentage. The fee structure takes into consideration any repetition in design work as well as total volume of work and no reduction will be made on grounds of repetition of size of project.
     
  3. The client shall provide all the possible assistance and data for the study. In case of complex projects like hospital projects where considerable research is involved, such research will be additionally paid for or other consultants engaged for it.  Demand survey and economic feasibility or market research studies will be separately paid for.
     
  4. The mode of payment and other terms and conditions shall be as indicated in the appended standard Letter of  Appointment which shall constitute the Agreement between the client and the architect.
     
  5. It shall be the responsibility of the client to furnish accurate site survey details described below and the architects shall be responsible for the time schedule only from the date such details are furnished. If any infructuous work is involved on account of wrong survey, the architect shall be additionally remunerated for it.
     
  6. As part of the services, the architects shall, from time to time, certify drawings are being correctly interpreted at site and the finishing is of acceptable quality and in case of adverse certification the payments of the contractor shall be with-held until the defects have been rectified. In case the architectural firm is required to verify and certify the bills of the contractors, additional fee of 1.0 per cent shall be payable.

CONDITIONS OF AGREEMENT

1. SCOPE OF WORK :

The architect shall provide service in respect of the following works:

1.1 Site evaluation and analysis

1,4 Sanitary, plumbing, drainage, water supply and sewerage work.

1.5 Electrical work

1.6 Landscape work

1.7 Interior designing

2. SCHEDULE OF SERVICES

The architect shall after taking instructions from client render the following services:

2.1 Prepare conceptual designs with reference to requirements given and prepare. approximate  estimates of cost by cubic measurements or on area basis.

2.2 Modify the conceptual designs with reference to requirements given and prepare approximate estimates of   cost  by cubic measurements or on area basis.

2.3 Prepare working drawings necessary for submission to statutory bodies for sanction   and   assist and advise  on formalities.

2.4  Prepare working drawings, specifications and schedule of quantities sufficient to prepare estimates of cost. Prepare a short list of contractors, together with appropriate justification.

2.6  Prepare working drawings including large scale and full size details detailed specification and schedule of quantities sufficient to invite tenders.

2.7  Prepare and submit complete working drawing and details sufficient to commence work at the site and proper execution during construction

2.8  Visit the site of work and provide periodic supervision as and when necessary to clarify any decision or interpretation of the drawings and specifications that may be necessary and attend conferences and meetings, as and when required and to ensure that the project proceeds generally in accordance with conditions of contract.

2.9  For frequent and constant supervision, Clerk of works shall be appointed. He shall be nominated or appointed by the Architect and shall be under the direction and control of the Architect. He shall be paid by the client or, alternatively, may be employed by the  architect, who shall be reimbursed the cost of the said employment including overheads. However the overall cost of the employment of the Clerk of works shall not exceed 2% of the overall cost of the project.

MODE OF  PAYMENT

For each of the services in the  scope of the architect shall be paid in the following stages consistent with the work done plus reimbursable expenses as agreed upon.  Payment made to the architect are on account and shall be adjusted against the final fee payable.

STANDARD SCALE  OF  REMUNERATION FOR COMPREHENSIVE ARCHITECTURAL SERVICES

Preliminary stage

Stage 1

On submitting conceptual designs and preliminary estimates of costs

Stage 2

On submitting the final preliminary drawings/designs along with modified estimates of cost

Stage 3

On submitting preliminary drawings for obtaining approval from statutory bodies. Working drawing stage.

Stage 4

During preparation of basic working drawings and details sufficient for preparing item wise estimates of costs.

Stage 5

On submitting detailed specifications, bill of quantities, detailed architectural working drawings, structural and services designs together with estimates of costs sufficient to invite tenders.

Stage 6

On submission of complete set of drawings and details sufficient for the work to commence at site.

Construction Stage:

Stage  7

During the course of construction of work at site the  site value of work  from time to time. The architect shall be paid the entire 20% of the fees in the event of the work not being completed within 12 months of  the date of stipulated period of completion of work

Stage 8

On completion of the work (to be paid within 6 months of completion  of the work)

 


15% of the total fees payable





25% of the total fees payable less payment already made.





35% of the total fees payable less payments already made.





55% of the total fees payable less payment already made.





70% of the total fees payable less payment already made.







80% of the total fees payable less payments already made.







Further 20% to be paid in installments consistent with the value of work from time to time.The architect shall be paid the entire 20% of the fees in the event of the work not being completed within 12 months of the date of stipulated period of completion of work




Balance payment making the total equivalent to 100% of the fees payable

4.   EFFECTING PAYMENT TO THE ARCHITECT :          

1) The payment to the architect during various stages shall be as  follows  

  (a)  At stage 1:   On cost estimates accompanying state 1 conceptual
                           drawings.

  (b) At stage 2 to stage 4 :  On cost estimates accompanying state 2 conceptual
                                         drawings.

  (c) At stage 5 :   On cost estimate referred to in that stage.

  (d) At stage 6 to stage 8 :  On the cost of the project defined in Note 5 below.

2) When the work is executed wholly or in part withhold materials or labour or carriage is provided by the clients, the percentage fees shall be calculated as if the work had been executed wholly by the contractor supplying the labour and new materials.

3) The cost of the project shall be the cost of the building work as calculated on the accepted   tenders including the cost of structural, sanitary, plumbing and electrical work, sanitary and electrical fittings & fixtures, lifts, i.e.

5 . REIMBURSABLE EXPENSES:

In addition to the fee payable under the preceding clauses, the client will reimburse the architect towards actual expenses of the following.

5.1 Local transport as per actuals. All expenditure towards statutory bodies for sanction etc., soil investigation report contour maps etc.

5.2 Cost of presentation models, rendered and coloured perspective drawings

6. CLIENT’S RESPONSIBILITIES:

6.1  Pay the fees of the architect within one week of submission of bills.

6.2  Take note of the observation made by the architect on his inspections and visits and ensure the correction of deficiencies in the work pointed out by him.

6.3  On the advice of the architect, prepare a short list of approved contractors who would be allowed to tender, invite tenders, select the contractors for the project in consultation with the architect.

7. EXECUTION OF THE ASSIGNMENT

7.1  All the stages of work should be informed to the  architect and the necessary approval given by the clients according to the time schedule mutually agreed upon. The work throughout the stipulated period of contact will be carried out with diligence, time being the essence of the contract.                                       

7.2 The architect shall prepare drawings, design, outline specifications and estimates of costs by cubic measurements or on areas basis on schedule of rates of the executing agency plus tender percentage and/or on Bureau of Indian Standards (previously ISI) specifications and per requirements. In the absence of rate in the aforesaid schedule of rates, the same shall be arrived at by actual analysis

7.3 The architect will advice the clients on the time and progress chart prepared  by  the  contractors for the completion of the work, if required

7.4 Appoint consultants in consultation with the client. The architect however shall be  responsible for the direction and integration of the consultant’s work. Consultants  shall be solely responsible for the competency and the detailed design and   supervision of the work entrusted to them.

7.5 The architect shall supply to the clients free of cost one sets of final drawings at Stage 2 of the agreements, one sets of all drawing, specifications and other particulars in Stage3 to 8 Any additional sets required by the clients shall be paid for on actual cost basis.

7.6 The architect shall advice client regarding the work under execution during visits to the site.  The responsibility for implementation of his advice shall be of client.

7.7 The architect shall not make any deviation, alternation or omission from the approved drawings, involving financial implications without prior consent of client.

7.8 The architect shall be compensated actual expenses incurred during extend period of  contract, if construction period runs beyond 12 months of the completion period as  per construction contract.

7.9 The architect shall exercise all responsible skill, care and diligence in the discharge of his duties and shall exercise such general superintendent and inspection in regard to such works as may be necessary to ensure what works are being executed in accordance with contract documents and shall endeavor to guard the owner against the defects and  deficiencies in the work of the contractor.

7.10 The architect shall make necessary revisions as may be required by client in the drawings and other documents submitted by him at the draft stage.  Any subsequent  revisions in the drawings and documents once approved required to be made by client shall be compensated as additional service rendered by the architect.

7.11 No change shall be made in the approved drawings and specifications at site without  the consent of the architect.

Note: If mutually agreed upon …….% of the fees may be paid as retainer at the time of   signing the agreement.
